Terms of Service

Welcome to Mogify. These Terms of Service ("Terms") govern your access to and use of the Mogify mobile application, website, and related services (collectively, the "Service") operated by Mogify ("we," "us," or "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old to use Mogify. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are between 16 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.
2. Account Registration
- You may register using Apple Sign-In, Google Sign-In, or email one-time passcode.
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate and complete information during registration and to keep it updated.
- You are responsible for all activity that occurs under your account.
- Notify us immediately at support@mogify.io if you suspect unauthorized access to your account.
3. Description of Service
Mogify is an AI-powered fitness and nutrition coaching application that provides:
- Personalized AI coaching conversations
- Meal planning and nutritional guidance
- Workout plan generation and tracking
- Food photo recognition and nutritional analysis
- Progress tracking (meals, workouts, water intake, body metrics)
- Restaurant menu analysis and dining recommendations
The Service is currently in beta. Features, availability, and functionality may change without prior notice. We do not guarantee uninterrupted access or specific feature availability during the beta period.
4. Health & Medical Disclaimer
Mogify is not a medical device, healthcare provider, or licensed nutritionist. The Service provides AI-generated fitness and nutrition information for general wellness purposes only.
- Nutritional estimates (calories, macronutrients, micronutrients) are approximations generated by AI and may not be accurate.
- Meal plans, workout plans, and coaching suggestions are not personalized medical advice.
- Always consult a qualified physician, registered dietitian, or certified fitness professional before starting any new diet or exercise program, especially if you have pre-existing health conditions, injuries, food allergies, or are pregnant or nursing.
- Do not disregard professional medical advice or delay seeking it because of information provided by Mogify.
- If you experience pain, dizziness, shortness of breath, or any adverse symptoms during exercise, stop immediately and seek medical attention.
You use the Service at your own risk. We are not liable for any health outcomes resulting from following AI-generated suggestions.
5. AI-Generated Content
Mogify uses artificial intelligence models to generate coaching responses, meal plans, workout routines, and nutritional analyses. You acknowledge and agree that:
- AI-generated content may contain errors, inaccuracies, or omissions.
- AI responses are not a substitute for professional expertise in nutrition, fitness, or medicine.
- We do not guarantee the accuracy, completeness, or reliability of any AI-generated content.
- Your conversations with the AI coach are processed by third-party AI service providers (such as Anthropic, OpenAI, and OpenRouter) to generate responses. These providers do not use your data to train their models.
- AI models may occasionally produce unexpected, irrelevant, or inappropriate responses. Report any such issues to support@mogify.io.
6. User Content & License
"User Content" includes photos, messages, feedback, and any other content you submit through the Service.
- You retain ownership of your User Content.
- By submitting User Content, you grant Mogify a worldwide, non-exclusive, royalty-free license to use, process, store, and display your content solely for the purpose of providing and improving the Service.
- You represent that you have the rights to submit any content you provide and that it does not violate any third party's rights.
- We may remove User Content that violates these Terms or applicable law.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Use automated tools (bots, scrapers) to access the Service without our written consent.
- Interfere with or disrupt the Service or its infrastructure.
- Submit false, misleading, or harmful content.
- Attempt to manipulate the AI coach to produce harmful, illegal, or abusive content.
- Share your account credentials with others or create multiple accounts.
8. Subscriptions & Payments
Mogify may offer free and paid subscription tiers. If you purchase a subscription:
- Payment is processed through Apple's App Store. All purchases are subject to Apple's payment terms.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- You can manage or cancel your subscription in your device's Settings > Apple ID > Subscriptions.
- Refunds are handled by Apple in accordance with their refund policy.
- We reserve the right to change subscription pricing. Price changes will not affect your current billing period.
9. Intellectual Property
The Service, including its design, code, AI models, branding, logos, and content (excluding User Content), is owned by Mogify and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.
10. Termination
- By you: You may delete your account at any time through the app or by emailing support@mogify.io. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
- By us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. We will provide notice when reasonably possible.
- Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Dispute Resolution) will remain in effect.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY OF NUTRITIONAL ESTIMATES, AI-GENERATED PLANS, OR ANY OTHER CONTENT PROVIDED THROUGH THE SERVICE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOGIFY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, HEALTH, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
13. Indemnification
You agree to indemnify, defend, and hold harmless Mogify and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
14. Dispute Resolution
Informal resolution first: Before filing any formal proceeding, you agree to contact us at legal@mogify.io and attempt to resolve the dispute informally for at least 30 days.
Binding arbitration: If informal resolution fails, any dispute arising from these Terms or the Service shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration shall take place in New York, New York, or remotely at the arbitrator's discretion.
Class action waiver: You agree to resolve disputes individually and waive any right to participate in a class action, class arbitration, or representative proceeding.
Exceptions: Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the Service.
15. Apple App Store Terms
If you download Mogify from the Apple App Store, you also agree to the following:
- These Terms are between you and Mogify, not Apple. Apple has no obligation to provide maintenance or support for the app.
- In the event of any failure of the app to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation.
- Apple is not responsible for addressing any claims relating to the app or your use of it, including product liability, legal compliance, or intellectual property claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government prohibited or restricted party list.
16. General Provisions
- Governing law: These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
- Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mogify.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
- Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.
17. Changes to These Terms
We may revise these Terms at any time. When we make material changes, we will notify you through the app or by email at least 15 days before the changes take effect. Continued use of the Service after changes become effective constitutes acceptance. If you do not agree to the revised Terms, stop using the Service and delete your account.
